Osler acted for Kinder Morgan Canada in connection with its application to the National Energy Board expansion of its Trans Mountain Pipeline system from Edmonton, Alberta to Burnaby, British Columbia. The $6.8 billion expansion will approximately triple the capacity of the existing pipeline system to 890,000 barrels of oil per day. The hearing was among the largest in NEB history and involved more than 400 intervenors and 1,250 commenters. On May 19, 2016 the NEB found the project to be in the Canadian public interest and recommended that the project be approved by Cabinet, subject to 157 conditions, in its 533-page report.

Osler represented Kinder Morgan with a team that included Shawn Denstedt Q.C., Maureen Killoran Q.C., Terri-Lee Oleniuk, Jeremy Barretto, Heather Weberg and Thomas McNerney from Osler’s Regulatory, Environmental, Aboriginal and Land and Litigation groups.
