Osler is proud to announce that our National Tax Group has once again been recognized as “Tax Disputes Firm of the Year” at the 2024 International Tax Review (ITR) Americas Tax Awards.
Osler is also pleased to be recognized as the winner of the Impact Case of the Year: Fiera Foods v. His Majesty the King. Osler represented Fiera Foods in its successful appeal from the Canada Revenue Agency’s denial of almost $6 million in input tax credits (ITCs). The case establishes the important principle that an ITC may be claimed when the information required under the Excise Tax Act is present, and is not to be denied on the basis of the form of the documentation, or whether the taxpayer was the issuer of it.
Osler was also recognized for three Impact Deals of the Year for the following deals:
- BMO / Bank of the West
- Osler advised the Bank of Montreal on its acquisition of Bank of the West from BNP Paribas for US$16.3 billion, the largest purchase of a U.S. bank by a Canadian lender to date.
- Dream Industrial REIT / Summit Industrial Income REIT
- Osler advised Dream Industrial REIT in its acquisition, in partnership with a leading global sovereign wealth fund, of Summit Industrial Income REIT for approximately $5.9 billion.
- TC Energy / Columbia Gas
- Osler advised TC Energy Corp on tax aspects of its sale of a 40% stake in the Columbia gas transmission system to Global Infrastructure Management LLP, a US based private equity firm, for approximately US$4 billion.
