Service

Indigenous

Our team advises clients on all aspects of Indigenous law across Canada.

Our team has extensive experience advising clients in every jurisdiction in Canada on the full extent of Indigenous law, consultation, benefits agreements and related litigation issues, which includes the drafting of hundreds of agreements with aboriginal groups in almost every province and territory in Canada. We provide comprehensive and national services to our clients dealing with Indigenous legal matters, both as part of the regulatory approvals process, agreement negotiations and other matters.

We provide clients with advice on the Crown’s Duty to Consult as well as with regard to reviewing, drafting and negotiating Memoranda of Understanding, Consultation Agreements, Benefit and Access Agreements, Impact Benefit Agreements, Participation Agreements and Surface Access and Treaty Land Entitlement Agreements. We have also had extensive experience drafting and negotiating land tenure agreements on Indian Reserve Land and First Nation Land Management Act lands and negotiating and securing projects under the First Nations Commercial and Industrial Development Act.

Our Indigenous law practitioners are Industry leaders and have also represented numerous industry clients in a wide array of Indigenous law related litigation before all levels of court and regulatory boards across Canada. In addition, we also frequently provide strategic government relations and negotiation-related advice to industry clients on aboriginal matters. We believe our lawyers have represented more industry clients, before more courts, in more jurisdictions in Canada on these matters than any other law firm in the country.
